Terms of sale

1. Purpose

These General Terms and Conditions of Sale (GTCS) govern the sales of products made on the website theyiddishclub.com by THE YIDDISH CLUB, a simplified joint-stock company (SAS) with share capital of €5,000, RCS Paris 909 513 400, whose registered office is located at 46 rue Raymond Losserand, 75014 Paris (hereinafter "the Seller"), to any adult natural person acting as a non-commercial consumer (hereinafter "the Customer").

Any order placed on the website implies full and unreserved acceptance of these GTCS by the Customer.

2. Products

The Seller sells Ashkenazi-inspired food products, accessories and clothing. Products are described and presented as accurately as possible. Photographs are non-contractual. The Seller cannot be held liable for any error or omission.

Products are sold subject to available stock. In the event of unavailability after an order is placed, the Customer will be informed and refunded as soon as possible.

3. Prices

Prices are shown in euros (EUR), inclusive of all taxes, excluding shipping costs. The website may display an indicative conversion to US dollars (USD), but transactions and invoicing are carried out in euros, unless otherwise stated at the time of payment.

Applicable VAT:

  • For deliveries in France and the European Union to private individuals: French VAT at the rate of 20% included in the displayed price.
  • For deliveries to businesses established in another European Union Member State with a valid intra-community VAT number, the sale benefits from the reverse charge mechanism (Article 283-1 of the French General Tax Code). The VAT number must be provided and verified before shipment.
  • For deliveries outside the European Union (e.g.: United States, Israel): the sale is exempt from French VAT. Any customs duties, local taxes and import fees remain the Customer's responsibility.

The Seller reserves the right to change prices at any time. Products will be invoiced on the basis of the rates in force at the time the order is validated.

4. Order

The Customer places an order online by following the process indicated on the website. The order is only definitively validated after payment confirmation. A confirmation email is sent to the Customer summarizing the details of the order.

The Seller reserves the right to refuse or cancel any order in case of a prior dispute, suspected fraud, or product unavailability.

5. Payment

Accepted payment methods are:

  • Credit card (Visa, Mastercard, American Express) via Shopify Payments
  • PayPal
  • Apple Pay

Payment is due at the time of ordering. Transactions are secured by the encryption protocols of the payment providers. The Seller never has access to the Customer's banking data.

In the event of fraudulent payment, the Seller reserves the right to suspend the order and to take any useful action.

6. Delivery

The terms, deadlines and costs of delivery are detailed in the Shipping Policy.

7. Retention of title

Products remain the property of the Seller until full payment of the price. The transfer of risk takes place upon delivery of the product to the Customer or to the third party designated by them.

8. Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to give reasons for their decision. The terms of exercise and the exclusions are detailed in the Return and Refund Policy.

9. Legal warranties

Products benefit from the following legal warranties:

  • Legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code): 2 years from delivery of the goods.
  • Warranty against hidden defects (Articles 1641 et seq. of the French Civil Code): 2 years from the discovery of the defect.

10. Liability

The Seller cannot be held liable for any damage resulting from improper use of the product, a case of force majeure, or the act of a third party.

11. Force majeure

The performance of the Seller's obligations is suspended in the event of an act of God or force majeure as defined by the case law of French courts.

12. Personal data

Personal data collected as part of orders is processed in accordance with the Privacy Policy.

13. Mediation and dispute resolution

In the event of a dispute, the Customer will first endeavour to find an amicable solution by contacting the Seller. Failing that, they may make free use of the CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice (14 rue Saint Jean, 75017 Paris — www.cm2c.net) or of the European ODR platform: https://ec.europa.eu/consumers/odr.

14. Applicable law and competent jurisdiction

These GTCS are governed by French law. Failing amicable resolution, any dispute will be brought before the competent courts of Paris, subject to mandatory provisions applicable to consumers.
